Announcing that the band will be heading into the studio to record their new album they have some business to attend to first.
Filing a lawsuit on the grounds that Avenged Sevenfold are in breach of their contract with Warner for attempting to get out of their current contract. Citing the seven year rule, allowing parties to leave personal service contracts under circumstances after seven years have passed, as their motive. They were then met with a breach of contract lawsuit on January 8th from Warner on the grounds that the band’s decision was unlawful… Appealing for compensatory damages,restitution and disgorgement of all gains and benefits that Avenged Sevenfold have received pre and post-judgement interest along with attorney fees and the like.
In the lawsuit it was stated that Avenged Sevenfold are required to produce a further two albums as well as a CD/DVD Live combo. Having already invested funds into the band’s future releases believing that their agreement would go ahead. However the original contract stated that there would be five albums, nevertheless the new contract states that it had been renegotiated to include a sixth album.
Stating that the record label has undergone many different regime changes from when the contract was originally signed back in 2004 and has not got the kind of relationship that there was before with the band. No doubt that whatever the outcome Avenged Sevenfold are one of the biggest bands going with their previous album Hail To The King making a number one position in the charts so major label’s will no doubt still be interested when that may be remains to be seen however particularly if you’re going to take on a company as big as Warner…
